The Youth Sailing Foundation of the Palm Beaches, Ilc. (“YSFPB” or “we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our websites https://ysfpb.org/ including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the site. 

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this 

Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification except as specifically provided herein. You are encouraged to periodically review this Privacy Policy to stay informed of updates You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted.

COLLECTION OF YOUR INFORMATION

Personal Data

Personally identifiable information, such as your name, shipping address, residence addresses, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with the Site, or when you choose to participate in various activities related to the Site such as adult sailing instruction or event participation. You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site.
If you are a parent or guardian registering a minor on our site, you agree to allow us to contact your minor through emails, apps (including push notifications) and other areas of online services. By using our Site, you acknowledge that the information we have retained about your minor came from yourself and not from the minor directly. Please see our SPECIAL LANGUAGE ON CHILDREN UNDER 13 section.

Derivative Data

Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site.

Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Site or our mobile application. We store only very limited, if any, financial information that we collect. 

Financial information is stored by our payment processor, Paypal or Square and you are encouraged to review their privacy policy and contact them directly for responses to your questions. 

Mobile Device Data

Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device. 

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Site to:

When you post comments, contributions or other content to the Site or our mobile applications, your posts may be viewed by all users and may be publicly distributed outside the in perpetuity.

We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy.

TRACKING TECHNOLOGIES

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information. 

CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

You may at any time review or change the information in your account or terminate your account by:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

CALIFORNIA PRIVACY RIGHTS 

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below. 

If you are under 18 years of age, reside in California, and have a registered account with the Site, you have the right to request removal of unwanted data that you publicly post on the. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from our systems. 

SPECIAL LANGUAGE ON CHILDREN UNDER 13

Our online services are intended for general audiences and we do not knowingly collect information from children. We recognize the need to provide additional privacy protections when children visit websites and apps where this Privacy Policy is posted. The following guidelines supplement our general Privacy Policy and follow rules set by the Children’s Online Privacy Protection Act (COPPA) and other applicable laws. This section notifies parents and legal guardians (“parents”) of the types of information we may collect from parents about their children, how we use the information we collect, our practices for disclosing that information and our practices for identifying and obtaining parental consent when we collect personal information from children.

This section only applies to children under the age of 13 (“children”) and supplements the other provisions in our policies, which generally apply to teenagers and adults. We urge parents to discuss with their children, regardless of age, the importance of protecting the confidentiality of any personal information, both on and offline.

Information We Collect About Children

Children can access many parts of our platforms without providing us with any personal information. However, some content is only available to members of the Site including the membership registration process and apps, which requires us to collect certain personal information. If parents choose to register their minor children, we require the parent to create a user profile for each minor family member, including children under the age of 13. The user profile may include first name, username, password, email address, date of birth, residence address and tee shirt size. We only collect the information that is reasonably necessary about a child so they may participate in activities as an Site member. We do not condition his or her participation on the disclosure of more personal information than is reasonably necessary. 

If we knowingly collect, use or disclose contact information collected from a child, we will provide notice and obtain parental consent in accordance with applicable law.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Use of Information

We use the information we collect consistent with the services requested by the child. For instance, we may use information to:
• Send a newsletter, receipt or other communication requested by the child;
• Respond to correspondence sent by the child. We may also use a parent’s contact information to communicate with the parent regarding the child’s activities at Youth Sailing Foundation of the Palm Beaches LLC.

Disclosure of Information

Information collected about children will be disclosed in the same ways described in the disclosure of information section of our general Privacy Policy.

Parent’s Choices and Access to Children’s Information

Parents have the option not to consent to the disclosure of their child’s contact information to third parties. Parents may also consent to Youth Sailing Foundation of the Palm Beaches LLC collection and use of their child’s contact information while refusing to permit the disclosure of that information to third parties. 

Parents may review the contact information we have collected at any time and may either delete that information from the child’s user profile themselves, or request that any contact information we have collected be deleted from our records. Please note that certain information cannot be deleted because of other legal obligations. 

Changes to the Special Language on Children Under 13

We may amend this section on Special Language on Children Under 13 at any time and will make material changes only in conformance with applicable laws. If we make material changes in the way that we intend to collect, use and share children’s contact information we will provide parents with notice. Accordingly, parents should update their contact information to provide us with current email addresses at all times.
